  • Contract Negotiation

    ·      Represented seller in sale of vacant land to developer and negotiated 7 million dollar sale for Seller.

    ·      Represented condominium renovation contractor in negotiation of multiple multi-million-dollar renovation contracts.

    ·      Represented international utility company in preparation and negotiation of contract for installation of underwater data cable in Southwest Florida.

  • Project administration

    ·      Guided contractor client in presenting and preserving claim for additional time and compensation following discovery of unforeseen conditions and delay caused by owner’s design professional that ultimately defeated owner’s claim for liquidated damages at project close out.

    ·      Guided contractor client on preparation and presentation of claim for additional time following design related delay to critical path of project.

    ·      Guided prime contract in presentation and preservation of claim for additional time following government-imposed shutdown of project due to resident objections.

  • Summary Judgment

    ·      Represented Defendant Supplier sued by Owner for negligent misrepresentation and Florida Deceptive and Unfair Trade Practices. Drafted and argued a motion for final summary judgment in favor of supplier and secured final judgment for client.

    ·      Represented Homeowners in Johnson v. Davis claim after Seller failed to disclose foundational issue with property before closing and secured summary judgment as to liability for Homeowners.

  • Jury Verdicts

    ·      Obtained verdict for mechanical subcontractor in action against payment bond surety after prime contractor failed to pay retainage asserting that subcontractor failed to complete its work. Jury rejected the contractor’s claims and found that the contractor breached the subcontract by not remitting retainage and that the contractor’s payment bond surety was therefore liable to the subcontractor.

    ·      Obtained verdict for a shell subcontractor in a 6-day jury trial against contractor on multimillion dollar condominium project in Miami Beach. Contractor wrongfully terminated the subcontractor and argued that subcontractor’s work was delayed and defective. Jury contractor’s claim and found that the contractor breached the contract by failing to pay the subcontract. Judge ruled that client was entitled to foreclose on lien and was the prevailing party entitled to an award of fees and costs.

    ·      Obtained a verdict for concrete supplier in claim against vendor where vendor claimed that supplier had overcharged him for concrete. Following a two day trial, the jury found for the supplier and awarded more than $250,000.00 in damages.

    ·      Defended commercial property owner in 8 day jury/bench trial for breach of contract and specific performance.  The jury issued verdict for the owner on all counts. The court also issued a final judgment in favor of the owner denying the specific performance claim.

    ·      Represented high end landscaper in 4 day jury/bench trial against residential owner for breach of contract and lien foreclosure.  Jury issued verdict in favor of client for full amount of the claim. Judge issued final judgment of foreclosure on the construction lien and against owner on its breach of contract/fraudulent lien counterclaim.

    ·      Represented kitchen cabinet installation company in 4 day jury trial against subcontractor.  Jury issued verdict in favor of the client for the full amount of the claim.

  • Appeals

    ·      Obtained affirmance of summary judgment in supplier client’s favor where owner sought damages for alleged delay in production and supply of trusses.

    ·      Briefed an answer to an appeal filed by Plaintiff on an award of attorney’s fees to Defendant client wherein Plaintiff argued that the award should be reversed on the grounds the proposal for settlement was invalid and that the reasonable fees awarded by the trial court had not been incurred by Defendant client. Third District Court of Appeals affirmed the Trial Court’s award of attorney’s fees to client.

  • Arbitration awards

    ·      Obtained a complete award for plumbing subcontractor following a 9-day arbitration hearing. The prime contractor terminated the subcontractor and then asserted an arbitration claim against the subcontractor and its performance bond surety seeking more than $2 million in damages. Following the arbitration hearing, the arbitrators found that the prime contractor wrongfully terminated the subcontract and wrongfully asserted a claim against the subcontractor’s performance bond surety.

    ·      Represented homeowner in 2 day AAA arbitration against contractor to recover money due for work performed. The arbitrator awarded the full amount of the claim while zeroing out the contractor on its counterclaim.
